BIREN|KATZMAN Pays Referral Fees

Referral fees provide a mechanism enabling lawyers to still participate financially in cases which they are not prepared to personally handle. The system benefits clients by encouraging lawyers to associate specialists whose involvement enhances the client's prospects for success.

BIREN|KATZMAN pays different levels of referral fees. Factors which affect the amount of referral fee which the firm is willing to pay on a given case include the following:

  • The type of case.
  • The fee structure charged to the client.
  • The degree of difficulty of establishing liability.
  • The level of anticipated monetary recovery
  • Whether the referring lawyers are willing to advance a portion of the case costs

BIREN|KATZMAN pays referral fees out of its fee. The firm never increases its fees to clients in order to pay a referral fee on a case. In short, the client pays the same fee whether or not another lawyer is sharing in the firm's fee.

CASE SCREENING PROCESS

BIREN|KATZMAN will screen any potential serious injury, death, insurance bad faith or financial loss case and provide a viability opinion. If we determine that the case meets our handling standards, we will commit to take the case if the client wants to retain our firm. The client benefits by obtaining an independent evaluation of the case and potential representation. The referring lawyer benefits by fulfilling ethical obligations to the client and by creating a potential for additional income.

The best way to discuss a referral is to call or e-mail one of our attorneys directly. Alternatively, referring lawyers can complete the below case screening form, which is sent electronically to BIREN|KATZMAN. The firm will review the potential case and respond within 1-2 business days. If we believe there is a viable case, we will call to discuss handling alternatives. If we believe the case is not viable, a letter will be sent to you explaining the reasons why. In some cases we may request additional information.

If you have not had experience handling the type of case involved, you can fulfill your legal and ethical obligation to the client and avoid malpractice by obtaining an independent viability opinion from a specialist.
