BIREN/KATZMAN'S 2005 Conquests

BIREN/KATZMAN had another banner year in 2005 representing individuals who substained substantial personal injuries and death. Most notable were the following trial and settlement conquests:

• In February, firm founder Matthew B.F. Biren won an extraordinarily complex brain injury trial in Santa Barbara.
  
• Later in the year, Mr. Biren won an equally challenging spinal cord injury trial in Riverside.
  
• The families of two track maintenance workers were paid substantial wrongful death damages in a confidential settlement.
  
• We obtained substantial settlements for a number of other plaintiffs, including almost $1 million each for 3 plaintiffs who sustained spine surgeries that necessitated fusion surgeries and 2 plaintiffs with closed head injuries. We also recovered about $500,000 for a business which had bought defective goods from a distributor.

Notable Works In Progress

As always, BIREN/KATZMAN is currently representing a number of plaintiffs who have suffered catastrophic injuries or death or who have sustained financial losses as a result of business torts or insurance bad faith. Examples of the more unusual cases handled by the firm include:

• We represent a group of former executives of Mandalay Bay Resorts and Circus Circus over the huge monetary losses they sustained when MGM wrongfully terminated their SERP (Supplemental Executive Retirement Plan) and paid these executives, who had counted on life time retirement benefits, off with inadequate lump sums.
  
• We represent a man in an insurance bad faith case against Safeco, his automobile insurance company. Our client had caused an accident in which the other person was seriously hurt. Because Safeco did not timely offer our client's policy limits to settle the claim, it proceeded to trial resulting in a $20 million judgment against our client.
  
• We represent a woman who was rendered a quadriplegic in a devastating motor vehicle accident. In addition to pursuing the driver whose negligence caused the accident, we are evaluating potential road design and products liability claims.
  
• We represent a business executive who received a significant brain injury when he was assaulted by a process server.
