Closed Head Injury Verdict In Low Speed Accident

Defendant drove, at low speed, into the rear end of Mr. Saenz' car. Mr. Saenz, a self-employed 43 year old video producer, struck his head during the impact, and was never the same afterward.

BIREN/KATZMAN had Mr. Saenz evaluated by leading brain injury specialists. Neurological and neuropsychological testing established that he had sustained a traumatic brain injury.

Defendant's insurer only offered $10,000 of its $100,000 insurance limits to settle the case, claiming that Mr. Saenz had only sustained minor soft tissue damage.

A Pasadena jury believed the evidence that the plaintiff had suffered a brain injury and awarded him a total of $857,806. The insurance company settled for the full amount of the verdict, despite its lesser insurance limits.
