Mentally Retarded Boy Injured In Fall Awarded $750,000 For Worsening Of His Condition

Jose Beltran, a 10 year old mentally retarded boy, fell off of an unguarded second story landing of an exterior stairway at defendant's apartment building. The fall happened because the stairway was in a dangerous condition.

BIREN|KATZMAN put together a team of experts including a pediatric neurologist, a neuropsychiatrist, a neuropsychologist and a vocational rehabilitation expert to establish that even though this boy was mentally retarded, he sustained a worsening of his condition. The experts testified that as a result of the boy's increased diminution in cognitive capabilities and emotional instability, he ultimately would have to live in a more controlled environment than would have been anticipated before the accident.

The case was tried and resulted in a $750,000 verdict.
