Workers With Lead Poisoning Settle For $2 Million +

Hoyt Benge and his co-workers were employed at the Prestolite Battery Plant in Visalia, California. The battery workers developed increased levels of lead in their blood, causing them to be sick in various degrees.

The UAW, which represented the workers, contacted BIREN|KATZMAN to see if the employees were entitled to compensation other than worker's compensation benefits. BIREN|KATZMAN brought suit against five manufacturers of lead working machines used in the battery production process.

BIREN|KATZMAN established that the lead processing machines were defective because they were neither internally ventilated nor designed for connection to a plant ventilation system, resulting in excess lead escaping into the atmosphere of the plaint.

Thirty plaintiffs settled, in stages, for an aggregate amount approximating $2 million.
