Jane Doe, a bank employee, slipped on dirt in the bank's parking lot, causing her knee to bump into the floor board on her pick-up truck. She then developed Reflex Sympathetic Dystrophy (RSD), a rare condition causing intractable pain.

BIREN/KATZMAN established that the unsafe accumulation of dirt in the parking lot had resulted from the landscaping contractor (the site was being remodeled) not having cleaned up after a recent rainstorm and debris from landscaping materials having run throughout the area where employees necessarily crossed in order to get to their cars.
