Jane Doe, a bank employee, slipped on dirt in the bank's parking lot, causing her knee to bump into the floor board on her pick-up truck. She then developed Reflex Sympathetic Dystrophy (RSD), a rare condition causing intractable pain.
BIREN|KATZMAN established that the unsafe accumulation of dirt in the parking lot had resulted from the landscaping contractor (the site was being remodeled) not having cleaned up after a recent rainstorm and debris from landscaping materials having run throughout the area where employees necessarily crossed in order to get to their cars.
The case settled, after opening statements were made in Ventura, for the policy limits of $750,000; the case had previously settled with other defendants and the total settlement exceeded $1,000,000.
