Abraham Perez had been working out his entire life. When he lifted 225 pounds on defendant's incline bench press, the backrest of the bench broke, causing his neck to hyperflex.
The defendant gym contended that it inspected the bench every day and did nothing wrong. BIREN|KATZMAN proved at trial that the inspections were superficial and that the integrity of the wood component of the bench had never been analyzed in the decade that the bench had been in use.
Mr. Perez who underwent a 3 level cervical fusion was awarded $1.88 million by a Riverside jury.
