Verdict Awarded in Low Speed Accident for Victim Who Suffered Head Injury
The defendant drove, at low speed, into the rear end of Mr. Saenz'
car. Mr. Saenz, a self-employed 43-year-old video producer, struck his
head during the impact and was never the same afterward. Biren Law Group
had Mr. Saenz evaluated by leading brain injury specialists. Neurological
and neuropsychological testing established that he had sustained a traumatic
brain injury.
The defendant's insurer only offered $10,000 of its $100,000 insurance
limits to settle the case, claiming that Mr. Saenz had only sustained
minor soft tissue damage.
A Pasadena jury believed the evidence that the plaintiff had suffered a
brain injury and awarded him a total of $857,806. The insurance company
settled for the full amount of the verdict, despite its lesser insurance limits.
