    Matthew B.F. Biren and Andrew G.O. Biren obtained a $3,000,000 settlement for a young woman who was injured when a beverage delivery worker ran over her foot at a local convenience store. Despite the relatively minimal initial injury, our client developed a severe pain syndrome that left her permanently disabled. While the Defense accepted liability, they disputed the existence and extent of the injury and pain syndrome.

    The Biren Law Group showed that all evidence pointed to the existence of a pain syndrome caused by the initial incident. We also disputed the claim our client was exaggerating her injuries to avoid going to her job by pointing to her stellar pre-incident work history.

The Biren Law Group brought a suit on behalf of Doe-2 and proved that the insurance carrier did not act in good faith.

    Matthew B.F. Biren and Andrew G.O. Biren obtained a $2.7 Million settlement for a woman big rig driver involved in a bad collision, who originally suffered a knee injury. When arthroscopic surgery did not help her knee symptoms, the Plaintiff had a total knee replacement, after which she developed Lupus, Tourette Syndrome, and Fibromyalgia. Defendant's medical experts contended that these post knee replacement issues had no causal relationship to the incident or knee injury. The Biren Law Group maintained that even if the Lupus, Tourette Syndrome or Fibromyalgia could not be reasonably medically related to the knee replacement surgery, the conditions at the very least became significantly worse because of the stress caused by the collision, injuries, and surgeries.

The gate ultimately came down on the electrician because it could only sense whether vehicles were in the path of the gate, not people.

Biren obtained a $1.5 million settlement for a middle-aged man after a car accident caused a traumatic hip fracture and dislocation as well as injuries to both knees. He was injured while in a Home Depot parking lot crosswalk when the defendant accidentally put his car in reverse rather than drive.

    Because of these injuries, our client, who was already on permanent disability, needed a hip replacement; in the future, he is likely to need bilateral knee replacements and a hip replacement revision. While the defendant accepted liability for the hip replacement, he argued our client’s knees were already degenerative and arthritic. He also argued that, after the hip replacement, our client’s life would be essentially back to normal.

As a result of the collision, the Plaintiff suffered severe facial fractures resulting, a traumatic brain injury and had to have his spleen removed. Originally the defendant insurance company tendered the $100,000 first level of insurance, but refused to the tender the $1 million uninsured umbrella policy because of a gap in coverage they claimed voided the policy. Biren Law Group maintained that the policy was intact and that coverage counsel was misreading it’s own insurance policy. The case ultimately settled for the policy limits right before the lawsuit was going to be filed against the defendant insurance company.

    Andrew Biren and Spencer Goldberg settled a case for $650,000 against an Orange County Property Management Company for a woman whose foot got wet while stepping over a giant puddle adjacent to the top; of a stairway and then subsequently slipped and fell while descending down the stairway causing her to sustain a serious tibia/fibula fracture. The defendant maintained that the stairway was in good working order and that Plaintiff was comparatively faulted because she had previously slipped on the stairway. Defendant further claimed that no one else had fallen on the stairway other than Plaintiff and that the puddle at the top of the stairway had nothing to do with the incident. The plaintiff maintained that the stairway was defective because the steps had a rounded bullnose edge that made it very dangerous for people going down the stairs when their feet were wet. The Biren Law Group further maintained that the only reason the incident happened was because the Plaintiff’s foot got soaked in the puddle at the top of the stairway and that the puddle was a chronic problem that the defendant was 100% on notice of.

    The case settled right before the expert discovery was set to begin.
